Is a mother who has a baby in California allowed to place the last name of the father on the birth certificate |
I know that while the baby is in the hospital, for security reasons, the child must bear the last name of the mother. But what if the father is out of the country and cannot be there for the birth. Can the mother choose to place his last name as the last name of the child on the birth certificate? I have a friend who lives in Ecuador. His girlfriend had his baby in California. He tried but could not get a visa to attend the birth. She told him that the State of California told her while in the hospital ( I assume a records clerk) that she could not give the baby his last name. Does anyone know if this is accurate information? As far as I'm aware, in every state of the US, if Mom's single she can give her child (on the birth certificate) any last name that she wants. However, she cannot list anyone on the birth certificate as the father without him being there to sign the Declaration of Paternity (a form in which he voluntarily acknowledges being the child's biological father). Well, if the mother already has the same last name, then it shouldn't be a problem, but since this is not the case, I believe that the father must be present with identification. I think this is correct, the state I live in demands that the person claiming to be the Father sign the birth certificate in person, or it's a no go! |
