An apartment rape in my complex.........what are my rights?


I'm a single lady living alone in an apartment complex that is in horrible shape and there have been rapes/break ins, etc before Iived there. I've been there a year and half, but am moving out in 2 mo's. There was a recent home invasion/rape just in the last week. And when I moved into this complex the access gates were broken and wide open. Although I know that they aren't security gates, but they've never been fixed and it's like inviting rapists and crooks right in.......I truly think if they were in working condition that that some crime could be prevented. And I can't get any information on the crime from my front office or the police dept...Isn't it my right to know if the guy was caught, etc.....I mean something......

According to the open records act, you can get incidence reports for your address for the last 12 months.

Make it a written request to your local police department. Use the apartment address. Mention the open records act. You may have to pay a 15 to 20 cent fee per page.

I would think the police would be eager to help, and that the manager should do something if they don't want to be subjected to a class-action lawsuit.
Write letters to the management, copy the police and a law office in the area. Good luck.

Unfortunately those are amenities offered by the apartment complex (access gates). If they are going to have them, you would think they would keep them in working condition, but they are not required by law to do so. I used to work for an apartment complex and we were very proud of how low our crime ratio was, so we would tell possible tenants that they could contact the police department and they would be able to tell them of any criminal activity that occurred on the property. So I know that the police department can give that information out, regardless of if you were involved or not. Thankfully you are moving out in 2 months. I hope you were able to find something better. If you haven't actually found a place yet, take it from me, the management company will make or break an apartment living experience for you. There are good management companies out there that take pride in their property and keep everything updated and in good working order. I hope your new place is like that!
