Child father on SSI... wheres my child support??!!?


I have a 6 month old child. Her biological father is on SSI. To me, hes just lazy.. hes not disbaled. He claims to be bi-polar and ADHD. He gets a check each month from SSI. I cant get child support because its a form of "public assistance". Some people have told me that I can get a check for my daughter from SSI... but when I called Social Security, they said I cant UNLESS the CHILD is disabled. Is this true? I mean, is there no way of me ever having any financial support for her? I dont see how people can just go out and make babies and never have to pay for them... there has to be some way for me to get some help?

If he would be receiving regular disability from SS,your child would receive a check. But,since he is on SSI,there are no dependent benefits given. SSI is given to people who haven't worked enough years to qualify for regular disability. You cannot receive SSI for your child unless the child is disabled,that is true.
He may still be required to pay you child support. File a case with domestic relations and see where it goes. If you can't get anything right now,the order will be in place if he gets taken off SSI in the future.

You have to sue the father for child support. You will have to prove the following;
He is the father of the child (DNA Testing)
You have to prove his has income that the judge can garnish for child support.

Once you have a decision, have the child support payments go through the court.
Next don't have children with lazy, layabout bums. Have more pride in yourself than that.

You choose to have a child, your life is not longer yours, it belong to that child. You need to do anything you can within the law to support your child, all on your own.

Unfortuantely for you SSI payments are pretty much untouchable. It is also true that your daughter has to be disabled to get a payment from SSI. Let it go and move on with your life and be grateful he is no longer in it.

If the Father is on SSI Disability, your child can also draw a check from SSI. You need to file for Child Support through the court or (many States) will file for you if you apply for Public Assistance or Medicaid for the child. You will not get "back-pay" so don't linger in applying for benefits. I don't know why the SSI office gave you the info that is untrue (except if you have never filed for child support, they are not aware of him having a child). My Stepson receives $630 a month since his Dad went on SSI Disability. Even if they deny a SSI claim, the Fathers check can be garnished for Child Support. You need to take action though, it's not automatic. There are 5 reasons for SSI checks to be garnished. 4 are for taxes and student loans, and the 5th is Child Support. This info is available at the SSI website.
