What is the legal proceding used to declare someone dead?

My husband disappeared 10 years ago. There has been no social security activty since 1997. What do I do to have him declared dead?

You have to file a civil action with the court where his last residence was for proper jurisdiction, and they will take it from there. There are mandated publishing periods, evidence required, etc to make sure he's not just somewhere else. :)

When you say no social security activity, do you mean no wages, no credit applications? You should have that printed up to take to the attorney filing your action to speed things along.

Have you filed a missing person report..Start at the beginning. You should seek legal assistance, you won't have any success without a lawyer.
