If someone was badly assaulted on city owned property, can he sue the city ?


If someone was badly assaulted by an unknown individual on City owned Street, the police later arrested the individual. The city is responsible for providing security to its citizens.

The assaulted person is badly injured; few of his back bones broke. He is out of work for last one month, and probably will not be able to work for several months.

Can the assaulted person sue the City for any compensation?

Your false premise is in the assertion that "the city is responsible for providing security to its citizens." Not true. Most cities have a police force dedicated both the prevention and prosecution of crimes, but no court anywhere has imposed liability for how the force deploys its resources. If the city was required to prevent harm to everyone, then they would have the authority to put everyone in protective custody. Frankly, I would rather not live in such a place.

Why would you sue the city? They can't be everywhere all the time. Assaults happen everyday all over the world. Maybe you should consider suing the person that did it.

No. The state cannot be sued without its consent. Based on the logical and practical ground that there can no legal right against the government which makes the laws and on which a right depends.

you can sure try to sue.. a very good chance you would get laughed at and lose this case. thus, losing money and wasting your time.

No. The city is not responsible for providing round the clock security on every street. Thats called a body guard.
