My husband is a security guard and is working at least 336 hours a month,this month he only had one night off,


he works permenant nights,is this a legal amount of hours that hes working?

No, there is a working time directive and he is working way more than that....however, I presume he is working the nights and the overtime to earn more money as a security guards wage is not very good.....so if he is volunteering then nothing to be done.

The Working Time Regulations say:

a limit of an average of 48 hours a week which a worker can be required to work - any excess must be voluntary

for night workers, maximum of 8 hours work in any 24 on average and a right to free health assessments

at least 11 hours rest per day, at least one day off each week and a rest break if the working day is longer than six hours

at least four weeks paid leave per year

It sounds like it's not legal

Do the hours he works (that you think he works) match up with the hours he's getting paid? Check his payslip and see.
By law, if he's getting paid by the hour they have to pay him OT wages after 40 hours per week. If he is salaried, they can pretty much work him what they want. My husband is also a security guard, but not here in the US. He works about 88 hours per week and hasn't had a day off since he got there, but all those hours are reflected in his pay.
If the hours he's "working" don't add up with the hours he's paid, you might wanna have a conversation with your husband to find out what's really going on. Good Luck

It is illegal if he is an employee (OH&S, labour and human rights laws). To get around this the employer may be paying him hours off the books.

If he is directly or technically self employed (ABN or company) he is responsible for his own actions and has little protection.

There is a huge shortage of security officers in Australia and especially reliable security officers. Your husband can probably demand a much higher hourly rate to reduce hours and keep the same income. I know of officers earning double the award rate.

I'm sure he is only legally obliged to work 45 hours per week , UNLESS he has signed an exemption form which means he is up sh*t creek. I had to sign one many years ago or face unemployment and I ended up doing 60 hours a week. I do believe that the EU is trying to enforce some legislation that prohibits any form of exemption.

I would speak to someone at a CAB and see what they have to say, also look at his Employment Contract and see what details is in there about working hours.

I'm Afraid the long hours come with the type of job hes in.
When i was in security i worked 110hrs a week
a total of 440 hours a month.
and never had a day off in 9months..
its not nice when you have young children and never get time with them.
That's why i changed jobs
a family man needs time for his family.

For most jobs there's an opt in form to working extra hours, but i think the EU says you can only go up to about 52 hours a week, then you have the right to not work any more.

He may not be working but having affair with other women.

He prob has a bit on the side, n i dont think it is leagal your only suposed 2 work 40 hrs a week!!

Slave labour. There are Human right laws.
