Are you allowed to use cameras at the mall?


im having a mall scavenger hunt TODAY and i really need to know if we will get in trouble for taking pictures of us in dresses, with security guards, posing with mannequins, etc.

There is nothing illegal about taking pictures at a mall. In other words, there is no law which prevents it. People may complain about being photographed without their permission, but they are in public and have no expectation of privacy.

BUT... while the mall is open to the public, it IS still private property, and many malls (mgmt) prefer that no one engages in photography within the mall. Same with individual stores. (If a store permits you to take pictures WITHIN the store, it doesn't matter what the mall thinks about it.)

Malls, however, nor stores, cannot detain you, file charges, nor confiscate your camera. They can ONLY ask you to desist, and if you refuse, then they can ONLY ask you to leave. If you refuse to leave, they can then call the police to escort you from the mall. And THEN, if you still refuse, you can be arrested for trespassing. That is a misdemeanor at worst, and still does not affect your camera in any way.

Go ahead and take the pictures. You may have a lot of fun, and the worst is that mall security may ask that you desist. Inside stores, just ask permission to take pictures of your friends, and they'll most likely oblige. It IS advertising for their store, and by asking, it's obvious that you're not trying to take sneaky pictures on the sly to catch them in something wrong.

Depends on the Mall and sometimes the guard on duty. Among things likely to cause problems are taking square on pictures of displays when people are not in them ("stealing the design"), pictures that might be structural ("planning a terrorist attack") and taking pictures of strangers that appear to show them in detail (like using a long lens and following one person) instead of crowd shots. Pictures that are obviously snapshots where the frame is mostly filled with a couple or 3 people.

The mall is a public place. Even if privately owned, it is open to the public and therefore everything and everyone is subject to being photographed without permission.
Some things are out of line, such as people using the ATM and dressings rooms. Use common sense and you'll be ok.

At the Fayette Mall(Lex,KY),most stores in there won't allow you to take pix,like inside of the store. They don't care what you're doing either. They'll make you take pix outside of the store,only.
But,it depends on mall to mall. Some will allow you to and some won't. I suggest that you go on and take the pix and have fun.

I think that is fine. I have a teenage daughter and about 2,000 pictures of her & friends at the mall. Ok , I exagerate, but you get the "picture"-LOL. and when we went to the Galleria in Houston, I took her picture there too.

uhm i think so as long as you don't get too obnoxious. if you start taking pics of other ppl (like straight at them, not in the background), someone might call security, but i doubt it

why would you not be allowed to take photos at the mall--is it secretly a defense depot ?
