Would this be resisting arrest? |
If I was skating and a security guard tried to place me under citizens arrest and I ran. If someone informs you that you are under citizen's arrest, then leaving the scene is considered resisting arrest. Only a police officer can charge you. Citizens cannot detain anyone, all they can do is inform you, then they must immediately call the police and an officer will sort it out. In Texas: PC 38.03. RESISTING ARREST, SEARCH, OR TRANSPORTATION. (a) A person commits an offense if he intentionally prevents or obstructs a person he knows is a peace officer or a person acting in a peace officer's presence and at his direction from effecting an arrest, search, or transportation of the actor or another by using force against the peace officer or another. I wouldn't think so, but then running does usually indicate guilt. Perhaps the security guard scared you enough to just make you make an impulse decision to run. |
