PLZ help. Can we do this for the child....? |
A child lives with the father and the mother lives in a different state far away. The mother barely visits or phones the child and sometimes her visit leaves the child in tears from the things that she tells him when they're together. The father now lives with a woman who cares for the child as her own from financial responsibility to emotionally security to the school recognition of her as a positive parental role in the child鈥檚 life. Since the birth mother lives in a different state and is not around the child often enough to make everyday necessary decision for the child, can the woman who lives with the child and father become the child's legal guardian without asking the birth mother for permission? No, not with out the court stripping the mother of her parental rights, and nothing you have said would make the courts do that. idk. I guess it depends on like which jurisdiction they're living in. Are the birth parents married? If they are, then the mother living far away is the responsible guardian with the father. If they are not, then I guess the father can marry the woman and they would be a normal family. It shouldnt be hard to prove in court that the mom doesnt give a rats *** about her child. How old is the child ? Why bother the father is already the legal guardian and the the step mother is doing a good job why bother going to court and spend lot's of money. I dont think so. My parents are divorced and even though we havent seen my dad in over 3 years, we still need him to sign passport papers etc. Hes a reall asshole and used to do some pretty horrible things to us and our mum, but the courts still are deciding whether to give him partial custody. U cant do anything if its a biological parent. I am not sure, but I don't think so. If the mother gives permission, that is one thing; but to become a legal guardian without the permission of a biological parent is not possible. absolutely not Yes but it is a court battle that could get ugly. |
