Is this ban legal and enforcable? |
my wife was banned from our local tesco store last week. she dropped something and swore to herself. the security guard heared her and immediatly came over to her and told her she was banned for 6 months. i asked him to show me his sia badge to which he replied "i dont have one, i only work part time" i informed him he was wrong and was working illegaly. we left straight after this. no manager told us we were banned only the security guard who was working illegaly so is the ban enforcable. and yes i have reported him to the sia TONY, this is in the uk. all security guards need an sia licence to work in the industry. no licence, no job. thats the law over here You should ban them from ever again getting a dime of your money! Many businesses maintain the right to refuse service. Their are of course conditions which make exercising this right dangerous for the store. For instance. You didn't really say where this is, nor what the "SIA" is. I assume this is in the United States. Is there more to the story? A history of outburst? Suspected of stealing? In the bigger scheme of life it does not matter, you were offended at this store by this officer, you sought petty revenge by reporting him. Good thing is its a store on almost every corner move on and let the hate or anger out of your heart. It does more damage to you then the people you are angry at. I bet he is not up posting about the incident. You cannot be banned from a store for saying a curse word as you drop an item unless the item fell from your shirt in front of the security guard. So you are safe, if you feel you have to go to the store go so peacefully, if that's all that happened he probably wont even remember you. If problem persist talk to a manager I'd make an appointment to speak to the store manager. Be extremely nice. That's the best way. Explain you understand that she perhaps shouldn't have sworn, but as your sure he/she understands, it was jut a spur of the moment thing that wasn't directed at anyone except herself. Also that you do feel the security gaurd over-reacted, alhtough are sorry for any offence taken. um, well certain stores and restaurants can, at their behest, refuse to accommodation/serve certain customers if they have in some way violated a policy or whatever may be the case...the legality of it may be another issue...it would depend on state statutes and the like...federal laws dictate that discrimination based on race, sex, sexual orientation, etc. are unlawful and will not be tolerated...if the local enforcement don't address the issue, the FBI will....but the store can claim its not discrimination, but a customer service issue.....the store apparently has rights, just like you...however I don't understand way a store would ban a customer given these economic hard-times. the manager,and only the manager,has ultimate responsibility for banning people from the store,in line with company policy.Ask to speak to him,or phone,if you can get through,or call in person,with a friend as a witness,and chat to him,calmly stating the incident,and your feelings.See what he says.Ask to see a copy of the rules regareding bans,and exclusions..... Are you a pair of chavs?! I've never heard of anyone banned from Tesco for dropping something and swearing.... Tut, tut, tut. Are you in trouble? I don't want to listen to foul and obscene language while I'm shopping in Tesco's, I hear enough on TV after 9 pm uttered by semi-literates who can't find the correct adjective to describe a thing or an event. I don't think it's enforceable. Even that guard wouldn't probably remember her if he saw her in the store. So, basically it's a word with no actions to back it up. Therefore the legality seems worthless. Plus, management doesn't seem to care You can take up the matter with the owner or the manager, if you feel if the security guard is illegal and his action is equally illegal. Write to tescos, i had a problem similar to this i wrote a letter to the top and got 拢20 voucher and an apology, SCORE! unless you were given a criminal tresspass warning from a law enforcement officer (police, not security), no, it is not legal nor can it be enforced. Yes the ban is enforceable and if she goes on their property (their cameras will get her) she will be charged with trespassing. Why shop at a store where they do not want you. i bet he just wanted to take out his rage on someone because his boyfriend gave him a back ache My next door neighbour works part time as a security guard for one of the biggest Tesco's in the UK.I asked him and he said if the security guard has reported her to head office the ban is enforceable.They will pick her up on CCTV and create a still of her which they then use to flag up people who are banned.Once she is seen entering Tesco she will be physically removed from the store.My neighbour said it seems harsh and the only thing he can think of is that they construed her behaviour as verbally abusive to members of staff (security)....although he said he thinks there's more to this as he's never known someone to be issued a ban for this type of behaviour. tesco? wtf is that! |
