Eviction and forcible entry?


so i have court tomorrow for eviction because we "didnt" pay rent. heres the deal:
Chad:cosign
Me:occupant
Chris:head of lease
Melissa:occupant
all lived in the apartment. April 2008 Chad and I paid our half of rent. Chris and Melissa didnt. Chad and I could not come up with their half. We got a 3 days notice, and then a thirty day notice. Chad and I moved out on April 20th. Chris and Melissa stayed there. We are going to court tomorrow for not payin rent. Will Chad and I have to pay the extra charges(250 from april still, 100 dollar late fee, and 500 dollars for may)? We didnt live there during may and have proof of that. we paid our share of april so will we be responsible for the rest of april and the late fee? I have never done this before. lol
Also Chad and I paid the 500 dollar security deposit. We will not be getting that back due to damages from Chris and melissa. Can we sue chris and melissa for that money if we have the proof we paid for it? any help would be appreciated!

also if chris and melissa dont show up for court today, and we have proof we paid for everything and didnt do the damages, could the late fees and rent be put on them?

Chris and Chad will be responsible for the past due rent and late fees, because they are the leasee and cosigner. Chris and Melissa can be sued for security deposit, if you have proof that you paid it and it was them that did the damage.

everyone on the lease is equally responsible in the eyes of the law. No matter where you lived, you were on the lease and will be paying for those months and fees. The damages and etc will be split equally. You can sue for the deposit only if you can prove you did not do the damage.

if you are on the lease then it is your responability
it doesnt matter the living araingements
