I think My Hipaa Rights Were Violated?


I will try to keep this as brief as possible while trying to explain it the best I can.
I am on Social Security Disabilty for Panic Disorder/Agoraphobia. I do have a Psychiatrist but being Agoraphbis it makes it very difficult if not impossible to get to my appointments. There aren't any close Psychiatrists or I would just switch Dr.s so my Psychiatrist receptionist suggested I try a GP. I have one I have been seeing for over 10 years now, which I had an appt. already scheduled with him for this past Friday. I went in and talked to him and tried to explain my situation, what I was suggested to do, I even had a print out of the meds I have been on for over 8 years, he wouldn't even hear me out. All he said was " He could not prescribe Psychiatric Meds" his cell phone rang, he got up and walked out of the office. His office is like a house, kinda hard to describe but everything is pretty closely connected, as he walked out of the office he is continuing to say over and over......

again how "she wants me to prescribe her Psychiatric meds" to the receptionist who came to grab my file.
There is a patient sitting not even 2 feet away and I know she heard him, he wasn't being quiet.
Not to mention probably everyone in the waiting room heard him. I was in tears.
I said " Does everyone have to know my personal business?" He was walking away and came back and said it again! I am tears at this point.
As he walks away for the last time he said to the receptionist " Tell her to go somewhere else" I feel I have been totally violated. Who knows what these other people think or what not, besides that, how was that anyones business besides the dr. and mine?
What should I do?
Oh and for a fact, my boyfriend was in the room with me and heard every bit of it and so did my mother. The receptionist just stood there with her jaw on the floor=(

Most gp's wont rx psychiatric meds. Most have side effects and sometimes it can be very hard to figure out the right combo or dosage. Most gp's will leave that to the specialist, just as most gp's wouldnt preform surgery, they would send the patient to the surgeon.

Not necessarily. All he said was "I cannot prescribe psychiatric medicines". He did not say anything about you. If someone heard him say that, they wouldn't necessarily think he was referring to you. For all anyone knew, he could have been talking about another patient.

But if it was clear to the people listening that he was referring to you, then this may very well violate HIPAA. I suggest you not go back to this place. Find another doctor.

that is very unprofessional of the psychiatrist. You should report him to board and file a complaint. It was not ethical for him to act that way. however, Im do not think it violates hippa, since your name, condition, and any medical info was not used. If he did say one of those things, then he did violate it. You might be embarrassed from the situation, but take it with a grain of salt and find a new doctor.

If you feel you were violated, then yes you were. To many doctors today are getting away with way to much. I beg to differ, a GP or Family Prac, does prescribe meds for behavior modification. I will be honest, sounds like to me he just did not want to do the paper work, that you probably have to do, for a person on a disability. I would notify, your SS, let them know what is going on. I doubt you could find a attorney to take the case....but, you might. If nothing else this Dr needs to give you a apology. If it was me, I would personally write him a letter, letting him know, how you feel.
