Can i file two law suits? |
okay so my sister was living with me at my appartment when i kicked her out for not paying rent she didnt give me back my key and now my lease is up and they are taking 250. off of my security deposit for the key. i email my mom told my mom to have her call me asap. well she did nbut didnt answer because i was busy with somnthing els and i didnt know the number so she texted me. asked her the key politly she replied not my proplem. if i take her to court at first i only want to sue her for the 250.but she left a couch at my apartment. if she counter sues forn the price of the couch can i do a counter sue for the two months that the couch was left there when i sign the vacation premisece paper it does say 250 for not handing in keys. Well firstly, that seems very steep that the landlord is charging you $250.00 It costs much less to replace a lock on any door. She can not sue you for the couch. She abandoned it meaning you are permitted to do anything you want to with it. A landlord cannot charge you $250 for a key. Why didn't you make a copy of yours and turn it in? There is more to the $250 than you have told us. You can if you have the money and time . First off they are not keeping 250 for a key. They are keeping it for a lot of other reason but the .99 cent key isn't it. If that was the case you could of made another one. yes you can... thats just stupid and would be a waste of time $250 for a key? Are you sure they are taking the 250 for the key? OK so you do have an arguable case concerning the key...she has no right to retain it and the payment comes from your deposit.But the couch I would advise you not to throw it away since this can hinder your case and give her the oppurtunity to counter sue.Thing is the courts are very favoring to those who come in court with clean hands who have done no wrong.You throw out that couch and you have a problem.But have you told her that she needed to come for the couch? did you give her ntics as to what you were planning to do with it that is throw it out? if you did she has no claim against you you gave her notice This sounds like a job for Judge Judy Are you keeping the couch from your mother or did she just leave it there? If I leave something at your house and make no attempt to pick it up, I can't sue you for it. Your mother created a bailment when she left the couch in your possession. She is entitled to pick up the couch. You are under no obligation to deliver the couch to her. She can not sue you for it unless you prevent her from getting the couch. |
