Can I sue the court system and police for this? |
I have been charged for Possession of Marijuana and Drug Perephanilia FASLEY...........Now listen CAREFULLY. It was my brother. He showed NO identification but gave them my social security #. Now he went to court and got fined, but NEVER showed identification ( I.D). How can the court system charge someone with something if there is never even any proof if that is the real person......Now i have found the original ticket ( which is how i found all of this out) on the original ticket it is made out to my name, BUT where my signature is supposed to be he accidentally signed his name like he forgot he gave them my name. The court system didnt even notice that. Now if someone can be charged and never have to show i.d. and prove it is really you, HOW MESSED UP AND WRONG IS THAT. Now i know the court system did something wrong because then anyone could give anybodys name and it not matter cause u dont have to show i.d SHOULD I GET A LAWYER AND SUE cause this will be on my record He would have been arrested for a possesion charge and fingerprinted. You can prove that it wasn't you... They had to finger print him, so your finger print would not match if they matched up the finger prints.. Contact a lawyer and clear your name.. and while your at it sue your low life brother for doing this to you most police, courts, judges have what is called "judicial immunity" they cant be sued unless they deliberartly or willfully conspire against you, or wantonly break the law to incarcarate u. Otherwise, no cop or judge would ever be able to arrest a person or make a legal judgement. Because miistakes do happen-innocent people get arrested, judged, convicted all the time. If you show that ticket and explain what happened, they might just take it off of your record. They could nail your brother for fraud or forgery, but they should take it off of your record. Calm down. They will also have your brother's picture for his "mugshot" when they arrested him. (hope to God this isn't your identical twin!) You should be cleared of all charges and if I were you, I'd be directing my anger at that idiot, identity thieving, dope smoking brother of yours. I would definitely get a lawyer if I were you. That's pathetic negligence on their part. Identity theft is aa crime no matter if it is in the family or a stranger does it. |
