Does non-US citizen need a valid visa to get a driver's license in NYS?

Hi, I have a NJ driver's license and it is expiring at the end of 2008. I will be moving to NY, and would like to obtain a driver's license. I held a F1 visa, and I graduated from Rutgers in NJ in 2006. I was wondering if I could get a NYS driver's license if I could provide 1) NJ driver's license with Photo, 2) Social Security Card Number 3) Major Credit Card with my Signature 4) W-2 Form with my SSN on it. All four documents gives me 6 pts total.

Thank you in advance for any help.

Hi, sorry I forgot to mention that I have a valid foreign passport, but since I graduated from college my I-20 is no longer in effect I believe. I am however, in the process of applying to graduate schools. But My license will expire before that.

go to www.nysdmv.com there you should be able to find the answer to your question.

I live in florida and my husband had to either show his green card (which he hasn't gotten yet) or his work permit which he does have. Call the DMV they will tell you

You need to show your visa or your green card...
