Is a security officer allowed to grab someone they saw shoplifting and also take their backpack?


Hypothetical: We'll call the person X
X walks into a shop. Gets in, packs his bags with some items from the shop, and gets outside. Security guard comes outside, produces ID, grabs X, and asks X to step back into the store. Does the security officer have the right to grab X on the suspicion (possible witness) of theft? Also, when X attempts to run, the security officer grabs his bag, and X doesn't get it back. Is that considered theft on the security's part?
Also, what rights does X have? Can the security gaurd be charged with assault and theft?

X ran and got away with it, but unfortunately his bag was taken. Do you think the Police will follow up the matter, or is it too trivial?

This question is actually two separate questions:

Q1: Is the security officer allowed to arrest a man for stealing:

A: Yes, ANYONE who sees a man stealing may do that, you don't have to be a police officer or security guard for that. As long as you hand him over to the authorities once you've done that, it's perfectly fine.

Q2: May a security guard take possession of a bag full of stolen items?

A NO, he may not. Only police officers may search someone's belongings (assuming he didn't steal the bag). A security guard (or anyone for that matter) can only ask a thief to remove the contents from the bag, but the suspect is not obliged to do so and the guard may not force him to. If he does, he can be charged with theft too. Note that if the stolen items are sticking out of the bag (if only by a little bit), he MAY remove them and hold them in his possession till the police arrives (at which state, he'll have to transfer the stolen goods to them).

And the guard can only be charged with assault if he uses excessive force on the suspect - more than is needed to apprehend him.

yea a security guard has the right to detain anyone they suspect is shoplifting...
as far as the bag..yes they can take temporary possession of it...
as far as assault the only way a person could press charges against the security guard is if they used excessive force against the "suspect"
after detained the store manager will b called, police and parents if "suspect" is a minor

If X is shoplifting then the security has all the right to stop them check them and hold there belongings until the law gets there,if X runs security has a right to hold them.acctually a citizen can do it ,its called a citizens arrest.No X cannot charge the with assalut because X was commiting a crime.

dude! really! if "x" stole the property from the store, the security guard has every right to aprehend the goods. that's why he's called a SECURITY GUARD! no you can't press charges, what r u gonna say: "yeah officer- I stole some stuff and the guard took my bag and grabbed my arm! but I got away so I want my bag back." yeah you do that.

You have got to be kidding!!!!! They can not only grab you, but they can use reasonable force on you!!!! Pepper spray, taser, baton.... Whatever else it takes to stop the crime and prevent the escape of a CRIMINAL!

hi Yes that is what the security guards job is to stop theft. yes he can stop you and remove your bag and take the goods out from it.

It depends on the state, but I think if you shoplift the security
guard can shoot you in the back with his magnum, as long
as the merchandise isn't damaged.

i dont think the guard would get into trouble for preventing X from stealing the stores merchandise i think the guard did his job well.

Yes, he is authorized to make the arrest and has the right to search the person and his belongings. It's a legal arrest.

No I don't think so.They are there to inform cops.They don't make enough to get stabbed or shot.

I think most courts would be hard-pressed to find against the security guard because he was just doing his job, unless it can be shown that he used way in excess of the force really needed to detain the thieving little git, whose actions simply put the prices up for the rest of us.

If the bag is believed to contain incriminating evidence, such as the stolen goods, the security guard would naturally want to hold on to it, whilst kicking the theiving scum-bag's face in.

As far as I am concerned, X is a thief, and desrves all he gets.

they can only touch you physically while in the store. once outside, all they can do is call the police and ask you to come back inside. my and a buddy, well, so when the guard ran after us outside and asked us to come back inside, i just kept walking. my friend is dumb, so he went back in. that guard didn't even know which one of us stole it, but was satisfied with one of us. i gave him the finger, and kept my prize. other guy got off cause of empty pockets. just keep walking. don't look back, and maybe just don't steal if you want to be sure not to get caught. i used to for fun, only from big business, no small chumps, but as time went on i turned 18, and realized i was lucky so far but best quit while ahead. then again, ALL THOSE BIG CORPORATIONS ARE STEALING FROM YOU ANYWAY. MAYBE THEY DESERVE ALL THEY GET. AND WHAT ABOUT MOMS THAT STEAL BABY FOOD B/C OF THE FAILING ECONOMY? DO THEY DESERVE TO GO TO JAIL? OF COURSE, RIGHT? SEE WHAT I MEAN ABOUT BRAIN DEAD SHEEP? THE LAW IS THE LAW, AND THATS IT. DIDN'T EVEN CONSIDER THIS SENARIO. GO AHEAD AND TELL ME WHY DID SHE GO AND GET KNOCKED UP IF SHE DIDN'T EXPECT HER HUSBANDS CORPORATE JOB TO NOT GIVE A CRAP ABOUT HIS FAMILY. THERE IS NO SUCH THING AS STEALING FOOD. I DON'T CARE WHAT YOUR PHONY BALONEY GOD SAYS....... i'd like to what you would do when you go from 40k to starving in a month, and what your answer to this would be if you hadn't eaten for days. THINK BEFORE YOU TYPE. i'm glad all my teenage pranks caused inflation to go up. then i get to see the look on your faces when bread breaks 5 bucks a loaf. still think i'm wrong? give up all your possessions and money and go be homeless for a week. just one week. then we'll talk.
