You must give consent in order for them to search your possessions. One exception to that would be probable cause. If they see an illegal item they can positively identify, they now have probable cause. The second exception would be the installation you are entering. Example would be a military base. Your car can be searched at any time. As far as use of force is concerned. The security guard has to react to the subject's action. An example would be, if you have a gun i have to positively identify the gun before I draw mine. I would also have to explain why I did what I did. |
