Need your advice on money I owe? |
I live in Puerto Rico were most of the comunities are security gated. I have been living in the same comunity for the past 34 years and two years ago I stopped making the monthly payments to the administration for the security services since they were not fullfilling the agreement. A few days ago I received a letter from the administration lawyers asking me to pay the full amount that I owe which is approximately $4,000 before 15 days or they will take me to court. I already wrote a letter (which I confirmed they received) to the lawyers asking them an appointment to meet and discuss any pay terms but have not heard from them. Any advice? we are a community of aprox 500 families an about 200 of us are on the same boat Get a lawyer, they can put a lien on your home. Make a list and point out ALL of the obligations that the Security has failed to address .... Well you should not ask for a pay term. You will end up signing papers for interest payments and a open and shut law suit, you'll lose. You can pay them what ever you have now and reduce to balance that you will be sued for. You got a demand letter and their not going to talk to you without a law forum/ court. They have to send you the demand letter before taking legal action. The first thing I would do is write them a check for the fees. However, in the memo section, write the following "paid with protest." This will prevent the administration from placing any lien on your home (or from taking any other drastic action) while giving you time to figure out how to solve the problem. Writing "paid with protest" means that you are paying the fees simply to mitigate your damages, but that you object them. Next, talk to your neighbors about the problem and see what they think about the situation. The more people you have in your corner the better and you may be able to solve the problem diplomatically rather than resorting to the courts. If that does not work, consult an attorney for additional advice. Do you understand that they can put a lien on your home and they could even force a sale of the home to satisfy the lien?
