Car damaged whilst parked up? |
My car was damaged whilst i was parked in the staff car park where i work. Its quite a bad dent etc and i am furious as the other driver has driven off without leaving any details. What if there is no visible sign then? I dont recall seeing one and have worked there 5 years. If in America, you could sue the car park for failure to secure your vehicle since money changed hands. The exchange of money for services constitutes a contract. You paid an organization who placed cameras around their property for the express purpose of protecting your property. Because of the failure to maintain their equipment, damage to your vehicle was done and the perpatrator has escaped their responsibility. I don't know how big the car park is, but if it is a staff car park then the same people will be parking there every day. Check the height of the damage on your car, see if there is any paint colour on it, then go around the car park and find your paint colour on another car of the offending colour. At least it gives you a starting point, whether you have the courage to confront the person...............!!!! As this is off-road (private car park) the police will not want to know, it is a civil matter. Sorry to hear about your dent. Seek legal advise and maybe the company will be responsible for the damages as their security equipment is not functioning and it is their responsibility and you do pay parking fees maybe there is a loop hole that the legal eagles maybe able to sort out for you call the police and file hit and run charges. contact your insurance company. have a copy of the police report for them. when i was in a hit and run, my insurance company waived my deductible because i wasn't in my vehicle. best wishes Check for the sign that says your car is left at your own risk. I'm sure it will be there somewhere in which case you can't take it any further with your employer or car park owner. I doubt it - most car parks stipulate that you leave the car at your own risk xxx You will probably find an "At owners risk " sign there too - It's happened to me too and is so annoying! No, you just have to cough up for the damages or lose your excess/no claims discount. Sorry I know this is a bit different but my car was damaged in a auto wash in the uk,the wash had a disclaimer sign but to my luck the bloke in the car next in line was a copper and he said the sign is not worth the money it cost to make it.So i went to the office of the garrage to which the owner said ,sorry mate thiers a sign up stating that its up to the owner so he's not at fault,to which i replyd the bloke at the back of me is a policeman and told him what the police said to me,within seconds he'd changed is tune and said get it fixed and send the bill to me.so the thing you should do is tell the carparking company that you paid for a service and you want them to stump up the cashits not your fault that the camaras was'nt working.goodluck |
