My roommate's car was towed and the "ticket" is wrong, is there anything he can do? |
The ticket written by our apartment complex security guards says that his parking pass wasn't visible, but it is adhered to the front window as is required. He was towed from employee parking, but it was after the office was closed (normally means they don't tow from there) and the rest of the parking lot was full. The ticket says that he was towed at 12:30 pm, but it was at night (when the office was closed) at 12:30am. The daytime staff said they wouldn't have towed him, can he take someone to small claims court for towing him even though he has a parking pass (they could have looked up his number from the pass and called him)...? Absolutely. Fight the ticket in small claims court, or traffic court depending on the circumstance. Sure they could have but they are under no obligation to do so. The onus is on him to prove he was legally parked there. As for the error in AM/PM, thats a common mistake and as long as the guard can articulate the error and the correct time the ticket will, in most cases, stand. |
