What is petty larceny in oklahoma? |
My son was in a store with a friend when he saw a t shirt he wanted to buy and picked it up and had walked up to the front of the store where the counter was when he got a phone call he reached in his pocket to get the phone when a security guard screams out hes gotta shirt so they arrested my son and stated he attempted to conceal the shirt and leave yet they charged him with petty larceny also the store has no cameras so they cant prove it also the friend that was with him, his mother confronted the store and guards and even admitted he just attempted to conceal it and they stopped him before he left which the complaint even states that almost to the exact words. no he never concealed nor left the store was in fact going to register to pay when he got the phone call and thats when the guard saw him they also never gave him a chance to pay he is 17 so its juvenile and he is taking it to court I just cant see how they can charge him with petty larc. when he didn't conceal nor left the store He can't his attempt to conceal would only constitute a petty theft if he had concealed the shirt and left the registry area on the side of the exit, if any of those come into play then plead guilty and pay a fine as well as restitution, if not plead not guilty and go to court.~ |
