I stay in a condominum, I have stayed there eversince it was first developed about 15 years ago?


My question is, eventhough the condo was not maintained properly, not even painted once till date today, and security was lax, so much so, that one night while taking a walk along the common area, which was not lighted at all, I fell into an uncovered drain, broke my teeth, and went thru an ordeal for 6 months.
I decided then onwards not to pay any maintainance fees to the developer, who has taken advantage of the system to delay of strata titles. Now I am being sued to pay up the maintainance fees, backdated plus interest, which i am unable to pay.
What should I do? Is there something called Justice?
too bad i did not have a hp with camera, or else i would have taken all the pics, of the incident.

You should have sued the developer for your personal injuries at the time it happened. If you are still within the statute of limitations and can prove your damages, you might sue now.

As for you being sued, I guess your defense is that they didn't perform the contract for maintenance so you don't owe money for maintenance. But this will probably not work. Likely that they will say that they could not do the maintenance because they were short on money and blame the shortage on you.

Your decision to withhold the maintenance fee was a poor one. But if you can come up with at least the fees themselves, you might be able to get them to waive the interest and settle the case.

You need a lawyer. Go get one.

You handled this all wrong. Why doesn't your condo have a board of directors to handle maintenance such as painting and repairs? You should have sued the Condo. corp. for your injuries. You may still be able to if the Statute of Limitations has not run out in your state. Talk to a lawyer. You could lose your home because of your actions.
