How do i recieve tax refund if seperated and spouse filed joint and had sent to him?


He has my social security number and a personal check account. I do not have his info on either, but checks will be made out to both of us,

He cannot file a tax return in your name without your signature.

You need to file your own tax return. Do it now.

If he already filed it will mess up his taxes for years to come, but it is a crime for him to sign your name.

The situation you describe could possibly set you up for identity issues in the future if you do not make a few changes.

First thing you need to do is get a separate bank account.
Even if it is in your destiny to recoup your relationship, it is always smarter for a woman to have her own bank account, in addition to the joint one. It is presumed that women will outlive men, so women need to have access to funds quickly in the event of an emergency.
Second thing - unless a lawyer sees this question and wants to find out more details - I don't think you will get the answer that applies to YOUR specific situation here. -- Seek legal counsel if you want to resolve this definitively.

If it is made out to both of you then you will need to sign the check to cash it. that is unless he forges your name and deposits into the checking account and removes the cash. I would open the lines of communications back up if you want to see that money.

Being seperated, you should have filed your own tax return. He MAY have a problem cashing the check, but may have had it direct deposited. Going to court is your only option now.

The check will be in both of your names IF you filed a joint return. He will need your signature to cash or deposit said check. If you have any doubts, see your lawyer so that the issue can be dealt with legally.

Sounds like your out of luck on this one.

Try and talk to him in a rational manner.
