Can I sue the school for not making the right decesion?


I got into a fight at school and it was with one of the kids who jumped me a week before the fight.
there was a video recorded of the fight and the principle saw it and said i was engaged in a fight but i consider myself self-defending.
In the video there is a teacher who comes out than goes back into call security but does not break up the fight.
In the video you can also tell that i did not throw the first punch and I got hit and them threw 2 punches & than back up.
The principle says that I was engaged in a fight since I fought back but my point is that, what was i suppose to do?
Can i sue the school for not having a safe environment and a teacher not breaking up the fight and making the decision to give me 2 days of out of school suspension?
There were witnesses who state that i tried to avoid the fight

I would definitely take this to a higher power. Go to the administration of your school district. Get your parents behind you. If necessary, contact an attorney. You should be able to defend yourself.

I am a college student and I just spent the past 2 weeks learning about teacher's rights and responsibilities so here is my 2 cents.

The suspension was within the school's rights. A fight is a fight.

The teacher had the resposibility of interceding. Teachers must ALWAYS try to stop a fight (at least where I live).

The school must have been aware of the threat of violence against you and failed to protect you in order for you to try to sue for not having a safe environment. It's called Title IX.

Have you asked your parents to talk to the principal. That should happen first. Then if they still feel you are being treated unfairly, take it to your local school superintendent and ask them for a "hearing" on the matter. Then if you get no satisfaction, you could get a lawyer, but its going to cost you a whole lot more money than taking the punishment for fighting and moving on would...

Sorry, life's not always fair.

Most school policies are pretty strict on the description of fighting. Although I disagree, the schools claim you should just "cover up" and not show any agression. Sounds like this is your schools policy. Teachers unions have now put it in their contracts that if there are school security officers, they do not get involved in fights. This lowers the chance of them getting hurt or sued. I think you will lose this one.

Definetly talk your parents ever since the Victoria Lindsay case people have been taking these kinds of things on a much more serious level. No longer using the excuse of "kids will be kids."

I would say probably not - breaking up fight is not the schools responsibility. You would have no chance of winning this one I'm afraid. Try to stay out of trouble.

You could try...but Because of the mutual combat rules..it doesn't matter who threw the 1st punch...it's the political correct way to resolve these type of crisis.

Uh; you can't sue anyone till you are 18.

No school can stop every kiddy spat.
