Why Do "Some" Employer's Choose To Cheat The Government?

instead of doing what is Legal and Honest? My Brothers Boss Gives his Employees 1099's each year and will not take Taxes out on his men because he has to pay Workers Comp, and Social Security on the men. All of the Men are hourly Employee's and the Employer provides Transportation to and from the Jobs, Pays them by the Hour, Provides "All" Materials for the men and pays them in Cash for overtime. When asked why he is cheating the Government, he replys that he can "Sub out hours", but none of these men are Sub Contractors.He also hires "Illegal Immigrants to work for him. Can't he get in trouble with the IRS over this?

These Men are Hourly Employee's whom work all year. This Employer has denied Employee's the right to have taxes taken out on them because it will cost him "Money" to do so with the Government.

1099 is used when some one is a subcontractor or is considered as such. At it's basic level it means that a person is hired to do specific job and is paid for it. The 1099 is reported to the IRS and then it is the employees job to claim the money.

If the employer is using this for all of the employees and still paying on an hourly basis there is a problem. Cash for overtime? The boss is playing fat and loose with the books and is ripping off everybody. He is a cheat. The legal citizens would probably be eligible for back pay.

The IRS, labor board and all of that would be all over this if someone called.

Yes he can get into a lot of trouble. A lot of employers do this, cuz it saves them a lot of money. If the work is seasonal it could be different. There is a certain amount of hours that an employee has to work before any of this becomes illegal.
Example: I used to work at a resort in the summer when I was younger, but since I only worked so many hours in the summer, my employer was not required to pay any taxes and stuff.

It depends what party you belong to re pubs believe that a company can do no wrong it can break all the laws it wants to it can hire anyone send work over seas or destroy the land it sits on then walk away. The re pub view is a company is not part of America and so should be able to do what they want.

Dem believe if you want to do business in the US that you should obey the laws and support America.

Re pubs love money it their GOD so anyway they can make is OK

First- They can NOT be employees and recieve a 1099. They have to be sub-contracters. Is your brother claiming his cash income??? I bet not, so he would violating the law.
Second- You have no Idea what it cost employers for unemployment, and workers comp and they also have to match social security. Maybe you do not realize that by doing it has sub contracted labor(which they are) your brother makes a lot more money. If the employer had to pay workmans comp,unemployment insurance and 1/2 of social security, these will be added expenses for the employer causing your brother to make less money.
