Is it illegal for my boyfriends EX to collect child support for a child that lives with us?

His Ex is collecting child support and Social Security benifits for a child that has been living with us for two years.... we are broke, she is paying a mortgage on a new house.... she will send $100 here and there, but all together collects around $500 a month for the child that LIVES with us.... WTF??? Is this LEGAL???? Please any info...

Unless the child is suffering from some debilitating illness even if the child lived with her if she can afford a mortgage she would be defrauding social security. If the child qualifies for any government money it would go to you as you are the primary caregiver. Regardless the ex is committing fraud. Your boyfriend needs to call Social Security and report this. It will help with custody and child support issues later.

She should be paying your boyfriend child support. A judge will see that she can indeed pay it since she has a motgage. Plus he will ask about how much money she put down regardless of whatever claims of poverty she makes.

You need a lawyer. If there are custody issues it shouldn't be too hard for a lawyer to sort out as the child has lived with you for 2 years and you have kept the child fed and clothed with no support.

Depending on the situation you might be able to do this at little or no cost with child services or something. Some other answerer will probably explain all of that.

No. It is not "illegal" and the previous court order for Child Support stands until he goes back to court to change it. The Child Support Bureau has no power to do anything except what they have court orders for.

Most definatly. You need to take her back to court. She will probably end up having to pay it all back, but you will have to be able to prove that the child has been living with you.
