Ex found a way not to pay child support..was approved in court?


Apparently he is bipolar and got a doctor to write a note saying he "cannot" work. The judge is giving him another 2 months to be free of child support after not paying for a year. My ex told me that his DR will be writing another note in June..so yet again he will be free of paying. This all happend last week in court.
BUT

I went out Saturday night for my birthday and he was working security at the club I went to! I took pictures of course and to top it off someone stole my purse so I called the police and they talked to him to see if he seen anyone take my stuff.

Now I have no idea what to do, he lied in court about not being able to work..but I have dated pictures and can get an officers statement proofing that he lied to the courts but I am not sure who to contact. My local child support agency wasn't much help so I am at a loss on who to contact the courthouse? Judge? Lawyer?

Anyone know??

Old: Apparently youre not a parent. I have not been paid child support in over a year, and now he has the courts telling him he does not have to pay. He will not sign his rights over to me and my husband. Thats his choice..now he has to pay.

There are standard Family Law Form Interrogatories that you can propound to father. Send him the questions and demand answers re: source of income for last 12 months, copies of last years tax return and W-2; where his saving and checking account are located and the account number. The Department of Child Support Services can do a "debtor examination" on him regarding all of this information.

At the same time, subpoena employment and pay records directly from this club you went to. Serve them immediately.

Request that he provide proof the he has applied for social security benefits if he is diabled. Get a court order forcing him to apply. If he is denied... then he can WORK.

Contact a private investigator to follow him around a few days to see if he works another job.

you should also tak to the owner of the club and find out if they hired him or a seperate security company. tell them you need to prove hes working or you're going to report them for paying him under the table if its illegal.

Contact the court house and ask for a new hearing, based on new proof you have. It would help if you have a lawyer, the judge will not look kindly on him lying in court, he may end up in jail

You there are times to count your losses and run, this might be one. Life is not worht the hassles that it rpvide in pursuing things like this!

Just because he is bipolar doesn't mean he can't work. Is the doctor legitimate? I've never heard of a doctor writing a note saying someone can't work and pay their child support. He must be able to collect SSI or Social Security. You should be able to get $ out of his monthly check. You can have your lawyer get the info or pass it on to the child support agency or your lawyer. The pictures and statement from the police should be an asset to you. Make sure you keep pushing the issue and don't let it drop. Unfortunately, no one is going to be as aggressive as you are. Call and keep calling. If you don't like the answer you get from the 1st person, call back and get another one. See if you can also get a statement from the club he works at. Gee, it would be illegal if he were working under the table....GOOD LUCK! Don't give up hope. He's a poor excuse for a man. Any man who can't take care of his kids and tries to screw the system deserves everything he gets!

Start with your attorney. They will know the best course of action to take. Speaking from experience, let me say this. If your ex is able to prove a disability that would be GREAT news for you. If your ex is eligible for disability benefits because he is disabled, then you are eligible to receive dependency benefits on behalf of your child from Social Security. The best thing about that is the Federal Government pays ON TIME, EVERY MONTH. No more waiting for months or even years for that court ordered support. Now if your ex is not disabled or declined by Social Security then all your lawyer will need to present to the judge is a copy of his denied application to Social Security, which your attorney can get, not you. Now the last option, if he is claiming to be disabled, but not filing for Social Security Benefits (never seen that happen), then the court can order him to be evaluated by a state physician. Furthermore, anytime child support hearings are held the court requires both parents to fill out some kind of paperwork regarding income. Both parties can get copies of this paperwork, and if he is claiming no income, I'll bet the IRS would love to get a look at that! Sorry to say I've been in this situation more times than I care to discuss. If you want further advice or have more questions feel free to contact me.

people with disabilities such as bi-polar and other mental disabilities or in some cases of physical handicaps do not usually have to pay child support, because they are not capable of taking care of them because cant hold on to a job that will allow it. but it does not take away the fact that they are the parents . they do not have to give up their right to be a parent . they cannot be held responsible for their disabilities.
