How would you determine if a company is under investigation by the U.S. Securities Exchange Commission (SEC)?

That information is available at the SEC site and at the Stock Exchange, since the companies are public.

If the SEC is investigating a public company, the company should have to disclose the nature of the investigation, if it is material, in the company's own quarterly and annual reports. If the SEC has filed a court action, the SEC's web site will report that fact. If the company is public and there have been any news releases, they should show up when you put the company's ticker symbol on the "get quote" line on the yahoo finance page.
