Can our landlord legally withhold security deposit for missing parking pass? |
In our city, the law (I've checked thoroughly) is that upon moving out, the landlord can only withhold security deposit due to THREE reasons only: damaged property, unpaid rent, and unpaid utilities. But you know how it is, the lease when we moved in is long and full of bullshit. Anyways, we moved out a few weeks ago, and our landlord is withholding ALL THREE of our security deposit because one of our roommates lost the one (and only) parking pass (only one spot among three roommates). Can he do that? Legally, according to the city, he can't, but the landlord is saying the lease says otherwise... It seems like that the landlord is initially wrong (because the city does't allow it), but well we didn't read the lease appropriately (like come on, what college student does?) and have we screwed ourselves over? no he cant ,contact an attorney , maany will talk to over the phone and tell you your rights If it's in the lease, he can do it. Read the lease carefully. It all depends on the lease. Even though your lease is long and full of stuff, I would still read ti to make sure they don't specifiably state if you don't return any keys or anything they will withhold your deposit. |
