How does social security know to stop sending checks when someone has died? |
My dad died recently...he was collecting social security due to health reasons...my mom was getting child support out of it (because he never paid any)...that was months ago, and she is still getting child support... The bum step-brothers - NOT minors... According to SS law. Next of kin are required to report the death of a person on S.S... The S.S. office will demand re payment of all paid after death. They will attach your pay and bank accounts to get it back. Who ever cashed the check could even go to prison for that Fraud. You can keep the Month he died in but better return any other payments. S.S. also checks death certificates by County. In time they will be at the door. Usually a death certificate is issued and that is when social security stops paying... i don't know all the in's and out's of it though... Social Security must be made aware of the situation. It is only hurting the ones cashing checks illegally because when caught up with they have to pay the money back. Theft is theft. Prison time is also a possibility if it is not reported. It is the estate's responsibility to notify ss. However, if your step-brothers are dependent, minor children they could still be entitled to his benefits. Most times the pronouncing physician - nursing home - or hospital contact the Social Security Administration. You can take a death certificate with his Social Security number to the Social Security Administration and confirm that they have been notified - BUT - if the children are still minors - Social Security will still send a support stipend on your father's behalf to help them until they reach the age of majority. u need to contact the office in person or by mail or phone/she is cashing that check that no longer belongs to her/unless they r a certain age/in school/disabled before 18/do the reporting promptly/.they will assist you in getting this cleared up/there may be a legal reason she continues to get these checks that u r unaware of/ |
