Bicycle stolen from a place with security.?


While staying at the KOA campground at the circuc circus in Las Vegas my bicycle was stolen from the rear of my vehicle. It was cable locked to the bike rack and the cable was cut.
The canpground has security they ride around in a vehicle and have a number to call. Since they have security are they Liable or am I out $2300

No. Just because they have security does not make them liable for theft. I had a home owners policy once that covered theft of items from my autos when not at home. Check with your ins. co. to see if you are covered. If not, perhaps you may want to add that protection to your policy. You can get that type of coverage under renters insurance also.

Do they guarantee their safety? if they do, then they are liable, because you expected them to provide a service they didn't. Otherwise, no.

unless they explicitly guaranteed the safety of your property, you would have to prove that the place was negligent in some way. Because they had some security, it seems unlikely that they had an affirmative duty to have more of different security.

Most likely you are out the property.Most places state on the contract/agreement that they are only authorizing you to park there"At your own risk".Security is only provided as minimal security,for safety issues.you could try to take them to court,but read the agreement/parking stub etc.It may hold them "not responsible".

Don't mean to sound rude but, Who leaves a $2300 bicycle "outside"?

Sorry to hear about your bike, I think Charles said it best as unless your car/camper insurance includes "items enclosed/attached" you may be out - bummer!

When you got to the campground you or somebody you were with probably signed something. Most likely in the fine print there was something that says they are not responsible for lost or stolen items. Circus Circus can as well show that they have provided an adequate amount of security

If you are in Vegas, great. If you are not that is a problem. If you just call them up and say that the bike was stolen they will want a police report. Policies or not they might be willing to reimburse you partially.

Another answer said to see about claiming against homeowners insurance. DON'T! Yes 2300 is no small sum but you would pay for it later. Your rates may not jump now but if you ever have a second claim for anything else your rates will jump far beyond the loss of 2300 over time. If you buy another house your rates will be a tad higher out the gate. But this is something that depends on your circumstances.

Now if you can claim it against your car insurance that won't be so bad. Many policies will cover that. They may want a police report as well. They might pay out without it if you have a picture of the bike and a purchase reciept.
