Can I get a security clearance?


I was born in the US with my mom being a US citizen and my dad is foreign-born from India. He went to college here in the 70's, lived here since having a permanent Visa but does not have citizenship. I have looked at the application and there is nothing that I have done myself to be declined. But can I still get a US security clearance with my father not being a US citizen.

Yes you can. Depending on the level you should have no problem, however, it is important that he be in the US legally. You should be eligible for a Secret and can even be granted a Top Secret. Just make sure to list him and any other foreign national relatives.

Unfortunately, the best answer here isn't the right answer. It does not depend on the 'level' and there never is 'no problem'. Each persons background is adjudicated on a case by case basis, there is no Yes or No. Report It

If you are seeking employment requiring a security clearance, YES, you should have no problem.

You seem to think, or it appears, you are concerned because your Dad is from India and not a citizen of this country. I don't know first hand, but you Dad is probably a great guy! If that's the case, why would his citizenship, or lack thereof, be a problem: it is you they are interested in. It is you they have to trust. And, like you said, you, as a person, qualify.

Yes and no, it all depends on the granting agency and the level of access that you will have and the CIRCUMSTANCES. Some agencies may have specific guidelines concerning the citizenship of your immediate family members. The adjudicative guidelines state this concerning that:

"counterintelligence information, that may be classified, indicates that the individual's access to protected information may involve unacceptable risk to national security;"

****This issue is adjudicated on a case by case basis. Each case is different*******

The adjudicative guidelines set forth by the President have specific rules and regulations that adjudicators must evaluate when considering a possible foreign influence situation. Please see my source #1 at guideline B.

Source #2 below is a link to the a DOD administrative court case involving an individual who is a naturalized US citizen, with most of his immediate family being foreign nationals. His Clearance was DENIED:

Source number 3 is a simular situation, but different circumstances. This clearance was GRANTED

So, as you can see there are different circumstances and different evaluations of situations concerning this issue. EACH CASE IS DIFFERENT, so there really is no way to tell with the information you have provided.
