Can I sue for being pepper sprayed by security at a night club? |
I was sprayed with pepper spray at a night club(Detroit, mi) for no apparent reason, by a security guard. I was not even in the club yet and we were negotiating a price to enter the club. I made no threats to HIM and he sprayed me. Is this sound like I will be able to sue the club? I'm sure the incident was caught on camera. Anyone can sue anyone. Whether you'll win is the question! you cant sue a night club, most of them aren't legal... yeah Maybe yea it was probably caught on camera...THEIR camera...so if you're going to sue them...they're not going to supply you with evidence...lol. i do not know Unfortunately, no. Video cameras wouldn't be able to tell what you were saying, so they could lie and say you harassed them. attorneys are the best for this question caught on whose camera? the club? I really think that u should not sue until u ask him why he pepper srayed u. If u loose the case, it would make u look so stupid GO FOR IT!!! I HOPE IT MAKES IT ON THE NEWS!! do you have credible witnesses? if you have credible witnesses. or it is on camara and it was unprovoked. hell yeah. can i get a cut? you could always steak the place out, find out which car he drives and key scratch it. tough guys hate that. I'm sure he has an incident report written detailing everything (whether truthful or not) to cover his butt in the event you did try to sue. OF COURSE you weren't doing anything. Girrrlllll, going clubbing in Detroit. You have my sympathy. Born and raised there (not Eminem style either I was 313 my whole life there). OK, you can make a police report and then pursue civil damages. Was the guy on drugs? What kind of door monitor pepper sprays paying patrons? Was he aiming for someone else? Yes, if you can obtain footage showing that you did nothing to make the security officer feel so threatened where he had to pepper spray you. But usually when something like this happens and there is a tape and the person know there wrong they wont give it to you. So I say pursue the case and make sure you have credible witnesses. Negotiating a price? You made no threats to HIM. yes...........of course I'm no attorney, but that sounds like assult. Yes, anyone can sue anyone. Finding an attorney to take the case might be a problem. I would call the city attorney and ask if this aledgely unprevoked attack would constitute assult. you can probally sue but keep in mind you will need sound witnesses and /or a tape would be better even if someone maybe recorded the conversation anything other wise its your word against hes . Well if you did nothing wrong and its on camera.. most likely yes.. well you are in the US you can sue for anything.. go for it lol I do Security not at a club but I at businesses and you know what? Theres always something that the victim is leaving out of the story. Yes there are bad Security Officers just like there are bad cops but trying putting yourself in there position someone coming up to them trying to negotiate a price can you imagine how many other people were trying the same damn thing? I work 3 jobs my pt job is Delivering pizza and you know what gets old to me is every damn time I drive into a apartment complex some idiot yells out "Got any free Pizzas" imagine if you asked me that very same question after being asked that 10 times earlier and your the one that i get fed up with and tell you to get lost loser. heck yah. get yo money You wont win. Sure, you could sue, but I'm sure he will tell a completely different story. that was an assault - it will be hard to argue that a big fat a $ $ 'd bouncer was feeling threatened to a point where he needed to use pepper spray - I'd sue him if that was all there was to the facts .. were you there with any witnesses ? I think everyone that was ever Pepper Sprayed was sprayed for "no apperent reason". Do yourself a favor and let it go. The only winners here would be the lawyers. |
