Can I sue my university for what campus security did? |
I was parked in a spot that was for faculty because I was late for class. When I came out a campus security guard came up to me and started yelling at me. I sat in my car and he grabbed me by my arm (leaving bruises that I documented). He continued to yell at me and would not let me leave. He told me he was going to take a photograph and when I asked him why he gave me no response. Soon after he let me leave the premises. I filed a report with the local law enforcement and I have had numerous pictures taken. There were no other witnesses. I went straight to the department heads of the university. I was just wondering if I could sue the university for negligence due to the fact that he is part of their faculty and staff and he did aflict pain upon me. Also, this incident has disrupted my daily ruitens and I no longer feel safe on campus. You can sue anybody for anything these days. In this case the only thing that would likley happen is that the security officer would get suspended. Sure you can sue. You may or may not win depending on the rest of the story. I don't think you can sue the university but you sure can sue the security guard for his actions. Absolutely--however, at the most it will be settled out of court. By the way for others who read this, do not just report college incidents with University Police or possibly better yet, don't report it with Uonly with your university security. When I went to college a young lady had a similar incident and since she reported it to the University Police she was told by them she could not then report it to regular Law Enforcement. After over hearing this I told my niece Never to report anything that happens at her college to the college security instead report it to area Law Enforcement. I'm not saying what the college stated was legal, but I did overhear them telling her and her parents that probably to discourage further action or negative news/stats about the college. |

Security guards can enter every area of a building they are guarding, unless the contract they are working under specifically restricts them from a certain area.
