Property Stolen from LOCKED locker at LifeTime Fitness. Security Cameras weren't on supposedly?


Life Time Fitness Inc. (LTM) on NYSE
All of my items were stolen out of a LOCKED gym locker at a Lifetime Fitness. With over $500 in lost belongings, the club is not offering anything as of yet. The thief or thieves tried to go on a spending spree, but only got as far as one convenient store. I would like to sue for the total of my losses based on a number of factors.

1. We are not given the option to use our own locks.

2. The security cameras that the staff initially pointed out, conveniently did not function during the robbery.

3. A single sign stating they are not responsible should not absolve the club of any and all wrongdoing each and every time.

Do I have a chance to win a small claims suit? Thanks!

Possibly. Since, the cameras weren't working at the time, I would in my mind think that maybe it was an inside job done by someone who works there. I don't trust people enough to leave anything anywhere even if it is locked. I leave all valuables at home. Maybe you should do the same after this little incident.

Doubt it. You didnt have to join the Gym based on their conditions.

You are to read the contract when you sign up.

I'm short the stock, so tell as many people as you can how LTM has screwed you.

File a lawsuit against them, state that their terms say that lost or stolen property isn't liable to them, their security systems conveniently failed during the time of the robber, ask to see if there is a log notating when the cameras where turned on and off everyday or if they are supposed to be running 24/7. The mere fact that you signed agreeing to their terms can pretty much void your argument completely, but if the company/emplyees, are not taking measures to protect their customers, then you do have a case.
