Can people be sued while they are only receiving Social Security as a sole income? |
I've been told by 2 people in the law field that people can't sue when your only income is Social Security. This is my mother's sole income since my father's death and since that's happened it's been hard just to pay what needs to be paid. Now a credit card company is threatening to sue when after bills she barely has $60.00 left a month. Anyone can be sued by anyone else at any time for any reason. no one can sue her , don't worry about it and talk to a attorney just to make sure about that. yes they can, and are quite often! yes they will take a precentage or throw you out on the streets happend to someone i know Not sure - call your local Social Security office. I think the answer is that you can sue someone but you will never get them to pay, because they don't have the money. They can bring the lawsuit forward, however if informed of her financial plight, they probably won't. This won't stop them from going after any assets she might have though, like a house or something worth $. In the end, they will probably send a nasty credit report filed under her name and her credit searches in the future might have an ill bearing. maybe the credit card company does not know that she is on SS, for all they know she could have other income and/or things like a pension, IRA, property ETC. Credit card companys can harrass you and send your bill to a debt collector, but can't sue you But the government can sue if it had a need to it happened recently and they put it on the news because the man only collected soc. sec. and owed a student loan Just tell her to call the credit card company and pay them 5 dollars a month.Even 2 dollars a month. As long as she is paying them something. Credit card companies choose the most vulnerable to scam anyways. So its not like they care about the financial situation. |
