New Mexico drinking law - can someone decode this a bit?


I'm turning 21 on Thursday. My wife is 19. Found some info on the APIS website, but it's a little confusing. Here's the text for New Mexico:

"
Furnishing of Alcohol to Minors

Furnishing is prohibited WITH THE FOLLOWING EXCEPTION(S):
鈥? private location AND EITHER
鈥? - parent/guardian
鈥? - legal-age spouse
鈥? one or more specified religious, educational, or medical purposes



Notes: In New Mexico beginning July 1, 2004, furnishing of alcoholic beverages to a person under 21 is specifically allowed when "a parent, legal guardian or adult spouse of a minor serves alcoholic beverages to that minor on real property, other than licensed premises, under the control of the parent, legal guardian or adult spouse,锟?or when "alcoholic beverages are used in the practice of religious beliefs." See N.M. Stat. Ann. 锟?60-7B-1(B)."

What I am getting from this is that at home, when I'm around, she can drink all she wants. What is the legal meaning of 'real property, other than licensed premises?' Does that mean if we go to Chili's, she can't have a margarita, but when we get home, she can have as much as she wants? *scratches head*

Actually - that's exactly what it means. You can't serve her/get liquor for her at a bar or at a restaurant, but you can liquor her up at home. Strange, huh?

Well... she can have as much as she wants (at home) however, if something happens to her while intoxicated, you will be responsible; "Under the control" of the parent, legal guardian, or adult spouse". So, she can not have drinks at a restaurant or any establishment that has a liquor license, however she can consume alcohol at HOME, under your supervision. So if she does drink, make sure she drinks responsibly and DO NOT DRINK AND DRIVE.

Close. You have to actually "furnish" the alcohol. She can't drink booze that her buddy brings over to drink with her (Unless the buddy gives you the booze, and you pass it on to your wife)

Exactly. If you have a barbecue in a park (Assuming alcohol is allowed in parks in NM) you can give her a beer. If you eat your barbecue in a restaurant that has a license to serve alcohol, you can't.

LOL, scratch away..... the laws about drinking as a minor in several US States are even more weird than that.

In New York, for example, a minor can drink beer or wine in a restaurant with their parent, but the parent must actually POUR the drink - the server cannot fill the minors glass, nor can the minor pour himself a 'top-up', even if his Dad is sitting right next to him.
