Can I petition the court to put joint property that my ex hubby and I own up for sale? |
My ex and I still own a mobile home and land.that is still in the hands of morgage company as it is still being paid for. Is there a way to petition the court to make us put the property up for sale and split the money? He is being a real pain in my side and I want to get out from underneath it. That way, I will no longer have any ties with the ex. Someone, PLEASE help ! I am at my wits end and desperatly need answers. Yes you can. Where I live its called "petition for partition of real property". You legally have a right to sell or liquidate your interest in the property. However, filing a court action is not the first step. The first step would be to offer (with a written contract) your interest for sale to him. If he refuses, then you can file action in court. That should have been taken care of in your divorce decree....if it wasn't, contact your lawyer and you'll have to go back to court to amend your divorce decree. |
