Anyone know about Property Laws in Texas? Recommend any good Lawyers in Texas? |
My parents bought their home over 15 years ago. It used to be part of a 5 acre track of land. When my parents bought their land they bought 1.3 acres of the 5 acre track. Recently their neighbor of around 10-11 years decided to sell after the death of her husband. When she put the property up for sale she had the land surveyed. The survey showed that the fence that has been up since before I was born (I will be 19 in June) has been moved. The neighbors want to put up a fence where their "real" property line is. The fence would then have to go through our house!!! We have talked to a lawyer about this and he says that since the original land surveyer was wrong it is the neighbors property and they are entitled to it. There is obviously a mistake here. Why would my parents have bought a house that is halfway on someone elses property? Since my parents have taken care of this property for the past 15 years and have paid taxes on it could it legaly be ours now? Any Texas Lawyers? My parents property is in Moody, Texas. It is about 20 minutes away from Waco, Texas. If that helps any... There are many good real estate lawyers in Texas. What city are you in? I would narrow down the selection process that way. Also check with the licensing association in Austin. They will also be able to tell you who is having "professional difficulty," something you would want to stay away from in an attorney. Call some title companies and/or a mortgage company and inquire about the attorneys they use in your area. Also, do/did your parents have a mortgage on the house? If so, there should be a title policy. A title policy insures the title to the property, and a survey is usually attached showing the land to be insured. Also, have your own survey done. Perhaps the person your neighbors used made a mistake. Property with metes and bounds, or a tract that is split up, the readings are difficult. Get your own information and a second survey is not a bad idea. |
