Can you really shot people in Texas for steping on your property?


I was told that "No reasonable cause" is necessary but if you wanted to shot a gun at a person for steping on your property you could. Even a "Repo" guy who was repossesing the car ... Is this for real???

I live in Texas and I can give you the exact answer to this. Texas is one of the few states that allows people (ordinary citizens) to carry concealed handguns as long as they have a permit to do so. You can legally shoot someone on your property in Texas ONLY if you percieve a direct threat to yourself or your family. And you better kill them dead or they can charge you with assault...Kind of a catch 22 situation...When you get a concealed handgun permit in Texas they will tell you...If youre going to pull the trigger...make sure you shoot to kill.

If they are on your property, and you have a POSTED private property sign, then yes!

If they are trespassing, i believe so.

I don't think so... I think that your thinking about Lousianna's Shoot the Treaspaser law... But there is no law that I know of that allows you to shoot a repo man... Although I do know that Texas did have a law that would allow a repo man to come into your home even if you are not there to collect there property.

That is not true, they have to be threatening your property, yourself, or your offspring, other than that I don't think that you can shoot someone for just stepping on your property, unless you clearly state that you cannot trespass on the property. In texas if someone trespasses after dark, they can be shot.

Trespassing is reason enough.
You gotta have it posted for "No trespassing".
The signs have to be all around the property.
There is a maximum space between signs.
Too big a gap and they're not legally trespassing and the signs don't count.
Here in Maine you can't shoot somebody for trespassing. Only if they come on your land and try to do you harm.
A few years ago a bartender in Portland shot and killed three guys who followed him home after the bar closed and wanted to beat him up. The chief of police and the DA wanted to press charges but the grand jury wouldn't indict him. He had to leave town because the cops were out to get him after they lost the case.

You better be able to verbalize a legitimate threat of imminent physical harm to yourself, your family, or probably even a guest in the home. I have a feeling that while you might not be criminally liable with a valid threat, you may get sued civilly and pay until rapture.
