Has anyone ever heard of a Lispendence? Or know what it means, or how it is done? |
The county has been trying to take my real property eminent domain and I recently learned that I could not transfer it to my father whom I held it for, for several years and every time I try to have a quit claim deed put into my father's name at the recorders office they tell me that they have no provisions to record it but I watch them record others people's documents some the same as mine! I have never established credit and I am not in debt so I do not understand how they could apply some thing called a lispendence to my property! Please if you know what this is or why they have done it please help me with some information! Or even how they could do this? The lis pendence is a notice that a lawsuit is pending, the outcome of which affects title. A lis pendence is usually filed by the lender to start the foreclosure process under judicial foreclosure (just as a notice of default begins the foreclosure process under non-judicial foreclosure) but are used in other actions such as boundary disputes, eminent domain matters, and easement litigation. I had a small account at my credit union in which they sent me a letter that I needed to sign, or the money would revert back to the state.I let it slide because I didnt care. It was only 2 or 3 dollars. I think if you don't sign something, or show that you want to keep the property, it will go to the state. Lispendence means it will be taken by the government if you don't do something. A lis pendens is a notice to the whole world that the real property or personal property in some cases, is subject to court action and that anyone taking title to the property or renting it, is subject to the final judgment in the case. |
