Would the taking clause of the US Constitution probably require the government to compensate a party if a government zoing regulation reduced the value of a person's real property by any amount? Eminent domain. No. There are any number of Supreme Court decisions that have held that merely a restriction that causes a mere reduction in value is insufficient to constitute a taking. |
