Ex wife keeping personal items? |
my fiancees ex wife paid for the divorice and refuses to give his class ring to him when the papers state ''there being no real joint property each party shall retain household goods and personal property of the parties in his or her possession'' doesnt that mean she has too. she says she wont give it till he pays for half but the papers claim "each party shall be responsible for his or her own attorney's fees cost paid. he never had one. is it illegal for her to keep it and how should he go about getting it back from her? its a class ring worth 500 dollars and his deceased mother paid for it According to it stating that personal property be in his or her possession then your fiance has a right to that ring. There is nothing in that (assuming here) that says "because she paid for the divorce she can take what she wants" Basically it stating that whats his is his and whats hers is hers gives him all rights to that ring. You can go to small claims court over that and call it "stolen property" if she doesn't give it back. Just because she paid for the divorce it doesn't change what the court ordered. Why does she want the ring anyways?? It probably isn't worth too much saying that most cost around 100-$200 when bought. It's more of a personal value. Shes just doing it to irritate you both. So do what you gotta do and get that ring back.. because according to the court, its his! Hire a hitman to do the dirty work. It is illegal, but is that all she's keeping? each party shall retain household goods and personal property of the parties in his or her possession |
