Liability to Landowner from Person Using a Prescriptive Easement?


I acquired a piece of property in Virginia two years ago and now have built a house. I have found that several members of the community use (and have been using for some time) a path that cuts across my property to access a lake. I don't really have a problem with this, and understand that they likely would be granted a prescriptive easement if I challenged them anyway. The question I have is if I am liable for anything if they somehow manage to hurt themselves while crossing my property? I have a "private property" sign posted at the entrance to the path and there are no real dangers on the path that I can tell. Thanks in advance for any advice you can offer.

Probably not. If there exists a prescriptive easement, the maintenance of the easement would be the responsibility of the persons in whose favor the easement exists, not you. If no easement exists, they are trespassers and your responsibility would be to not injure them through willfull or wanton conduct (like placing trip wires or holes on the path) or through gross negligence. (failing to remedy conditions on your property which involve a high degree of risk of injury).

This will of course differ substantially from country to country, and in the U.S. from state to state. Historically, with the UK more lenient. This will have to be determined by court and will hinge on "attractive nuisance" and negligent liability.

In the U.S., the maintenance of the easement, however held, remains the responsibility of the underlying landowner unless specifically transferred in the easement document.

If you live in the U.S. and there is no easement on file with the County Recorder, I would stronly suggest you fence the area and protect yourself. If your neighbors do file suit for prescriptive easement it will be up to them to provide a case based on state statute.

In the meantime, you, as landowner, will continue to be responsible based on normal care doctrine.
