Anyone been through this?Who is liable for damage? Australia?


The neighbouring house was demolished. My house and the house that was demolished were free standing but so close they touched. The demolished house encroached on my property.Yes, I objected. Both houses circa 1890. A delapidation report of my house was done before demolishment. I have extensive damage to the wall that is now exposed, its a real mess with
mortar everywhere, large gaping holes where the houses touched at ground level. The demolisher said builders would have to remove the rest of the house next door because my wall was coming away. My exterior wall wasn't meant to be exposed the bricks dont match the rest of the house. The house that was demolished was also part of the dividing fence. Council put conditions on the demolisher and developer that state my house is " to be repaired and weather sealed at point of contact" I have already had an argument with the demolisher about the need to fix damage to my roof, not a good sign. Anyone know what legislation relates NSW ty

Unfortunately, you are going to need a lawyer. Avoid this if you can by settling. Threaten legal action, even send a legal letter, and get the council to do it as well. Then settle. Going to court means you will be going up against the builder and his insurance company - insurance companies will spend millions to save on paying thousands, and you have no guarantee of winning, and could get stuck with costs. The council is unlikely to help you, they are usually hopeless, and take forever. Best chance is to tell the council you are going to speak to Today Tonight or A Current Affair on how they have not got the builder to fix things, then tell the builder the same thing. Then settle.
