My father inherited a 1.3 hec. of land but...?


he just found it out when the Philippine government award its cerificate to him thru land reform.( the land is used for farming) but the land is being used by other people....for several years already.... and the property tax for it was almost gone up to 50 thousand pesos,... my father wants to sell the land, just want to know if is it possible coz the land has been used as collateral for loan..before..according to him.... when the real owner was still alive....any help pls ...

the govt. has awarded its title back to my father.,, so do you think the bank still have the right for it? and those people who use the land for farming knows that it was my father who owns it....

the first two problems are workable, but that last one...
i don't think the bank will give up that land so easily

There are three major problems that I right away saw in this 1.3 hectares piece of property located in the Philippines that your father inherited. First, the squatter problem. Second, huge property taxes that remain unpaid, Third, loan where this land was given as security for the payment of that loan.

If I were your dad, I would not want to have anything to do with that land. Its current market value might not be enough to even cover all the expenses he will incur in resolving the above three problems. The Philippines has an existing law protecting the squatters. If you are still not aware of that, I am telling you now. It is called Lina's Law. Your father has to pay all those squatters sufficient amount of money to enable them to move their respective houses somewhere. That somewhere has to be provided also by your father.

Then, there is the loan wherein your father had no part and now, he needs to come up with the amount of the principal loan plus interests. Considering the length of time that had elapsed since the loan was signed, there is the probability that the bank has already foreclosed the mortgage of your dad's inherited property. All those things will definitely eat all the time, energy and money of your father, and I think it will not be worth the effort.

And don't forget the unpaid property taxes plus interests.

This is only my honest opinion.
