Does the county have to pay us land owners for our trees they are cutting down, the trees are on our land?


I live in Green Lake Country, in WI and the county is on this kick to cut all trees down in the right away (no real good reason, just less of a chance of them being sued if someone hits a tree). Being the trees are on our property (land owners), does the county have to pay us for cutting our trees down? All they have offered is we can keep the wood (big deal) but our land value will go down, safety issues and other reason why we did not want them to take them down.(we took it to court becasue we say it is a three rod road and they made it a four rod road, court said four) I have a huge black walnut that is only on their right away by 4 inches (my side two and a half feet) and they say they can take that down also. I am looking for factual reason, not opions, there is a board meeting tonight (Monday) and I want to know what I am talking about when I speek.(they dont listen, but will give each of us three min to speek) Small town politics, were know as the Good Ole Boy Government

Law is on there side if they are using "right-of-way". It doesn't matter how wide the road was or will be...the county has right-a-way at least 10 feet on either side of the road (more or less depending on the jurisdiction).

To answer your question about payment, however, if there is not anything in the statutes already to provide for payment, they do not have to pay you. All they have to argue is that the trees are within the right of way and claim public safety as the justifiable cause to remove the trees...sorry, but I have been down this road myself and you are in a no-win deal if the county has already made up it's mind to start cutting....the best you can do is see if they will allow and assist in moving the trees further back on to the property. You have a better chance of that then stopping the cutting. And it is the same soil so the trees should survive better.

My parents planted a bunch of pines and when they grew it was hard to see around the corner of the road. I'm not sure if it was the county or town but they moved the trees back further off the road and my parents didn't have to do anything or pay for this. Report It
