If my husband's ex wife puts a restraining order on me, will he have to lose his guns?


In my emotionally distraught state last night I stupidly sent her an email calling her a greedy, money hungry psycho (which she is; she lies in court claiming she makes zero and is disabled but owns 3 million dollar plus properties including a $1.6 million home she bought recently, yet she comes to court dressed like a bag lady claiming poverty and saying she's thinking of applying for welfare. She makes over $300K/year. So it got to me, how much the judge has believed her because she refuses to provide Discovery on her real income and hides assets, and last night I was so upset cuz we're struggling to pay the$2000/month child support to this vindicitive person who has tried to make our lives hell. CAN SHE GET A RESTRAINING ORDER AGAINST ME AND MY HUSBAND FOR THIS??? Even if he had nothing to do with the email I sent (can she still get it against him? And I did not threaten her. He's afraid all his rifles will be taken and he won't be allowed to hunt in any state in the U.S.

Not all Restraining order are ordered to prevent violent acts. It can be a RO to prevent many behaviors such as verbal harrassment or something like that. If you threatened her with physical violence and you have no history of being violence, the likelihood of you husband's guns being ordered out of his possession is not likely. Read the restraining order. If it was an emergency order or temporary, it is issued very simply but a judge can make it last for a longer period of time. Make sure you attend the hearing though. Show the judge that you are actually rational but just lost your cool for that moment. The judge may find that there is no real reason for it to continue if this is your first encounter.

It would be best if you not have further contact with her and let your husband deal with her up front and you support your husband from behind the scenes. Do your homework and have valid proof to discredit her before Family Law judge on the financial matters.

As long as the guns are legal why should he have to give up his rifles unless there is more to this story. have you considered hiring someone to investigate her to uncover her assets?

If the restraining order says so then yes. Otherwise no. Please stop posting this question. Only the judge signing the order will know the answer to this questions, and I doubt he/she is on this site.

if she is lieing to a judge in court and you can get the info that proves she is doing so, and take it with you the next time you all have to go to court she will lose her case ,and there is a good chance she will be charged with purgergy wicth can get her some jail time

She is probably trying to get his guns taken away since she knows he loves them so. She more than likely told quite the embellished story to get that restraining order on you. In fact, she had to make you sound like you were stalking or threatening to do bodily harm to her in order to get one at all. I think the law is different in every state, but mostly I think if he is not a felon and has no history of violence, they won't try to take his guns. But like I said, it depends on the laws where you now live. Call the magistrate and ask what the law says about your situation. It might not hurt, if you have an attorney, to speak with him about it all as well. That is your best bet for finding out what you're up against with her. Exes can really be a problem when they continue to be vindictive and, as always, money carries a lot of weight. She can play the ragged tramp role to the max, but the truth is that she has money, so she has power. That truly sucks. Get the info you need from the lawyer and store up your ammo for the next round of fire with her. I just bet she's not through yet!
