A girl 23 yrs age was forced to sign a GPA before marriage.when revoked after 28yrs all her properties gone.?


just before marriage the innocent girl was told to sign this General Power of Attorney by her parents convincing her that it was for operating fixed deposits, receieving various financial claims on her behalf etc. However after her marriage when she was away with her husband in far away places, these very parents of her transferd most of her properties on their sons name and misused the GPA.After almost 28 years or so when she came back to the native place she got some doubt about the GPA's misuse and asked them to revoke.lot of pressure was put on her but she insisted to cancel the same. When checked the details of transactions done based on this GPA, it was found that most of her properties (landed) have already been transfered and she was left with almost nothing.Her brothers who got her properties became her enemy. her parents dont even talk to her. She is in a fix and dont know what to do an whom to apply. Can anyone help or guide ?...And believe me this is a real storry..!

when chcked the GPA with a lawyer it was found that it was not properly written nor shown the purpose nor the reasons. He says the entire deals are questionable as it is too old (28 yrs).

After 28 years all said & done in this case the very fact any change of ownership of any property both movable and immovable even though by fraud the case of adverse possession of these properties will always weigh in the favor of the other party. The limitation period of 12 years have already passed for this girl to legally challenge any transaction of the property that was in her name but was done on the basis of her GPA although not properly drafted but was not even challenged by any governmental authorities any time. Sorry to say this case will be another headache for her if she goes to Indian civil courts challenging these property transaction once belonged to her but were done fraudulently by her parents/relatives.

Talk to a lawyer would be the best advice.

A person over 18 years old (generally) has the freedom to contract however they see fit. While she may have been coerced into signing the GPA, she did sign it and it would likely be enforced.

She could try to reverse the transactions done by her parents under the GPA, but it would be an uphill battle and probably fairly expensive.

Get an Attorney. If they lied to you about the purpose of GPA sue them. Publicize the facts in press. Send letters to all of the their friends and people they do business with. Only send facts. They ripped you off and should be ashamed of themselves. Help them understand this.
