Can an organization ask questions like this when hiring you for a job...?


Since the age of 18 have you ever had sexual contact with person(s) you were seeing in your capacity as a professional (i.e. teacher/student, doctor/patient, lawyer/client)?
Since the age of 18 have yo uever had sexual contact with person(s) for whom you had a responsibility as a volunteer (e.g. youth leader, camp counselor, tutor, etc)?
If you are a parent have your parental right ever been terminated, suspended, or restricted?
Since the age of 21, have you ever had sexual contact with a person that was under the age of 16?

There were 8 questions total for this Abuse Screening, all of them pretty similar to the ones above. Legally can an organization ask these things, and then have you identify yourself by signing your name at the bottom?

They can ask.

You do not have to answer.

But I suspect they were appropriate for the situation. What kind of job is this? Will you be in a position of authority over at-risk kids or something?

Absolutely as the questions themselves to to the moral and legal character issue of the employment relationship.

If the job involved contact with children, YES they can.

The applicant can always choose to put "no response" or "5th Amendment" to avoid prosecution for any crimes that the applicant may have committed for which they have not been prosecuted.

They probably can ask it because it is just questions. Just answer NO to all of them and then you wont have a problem.

If you are applying for a position of trust around children or the incapacitated I would hope these question were asked.

I would say this kind of questionnaire is put in your personnel file and never glanced at again unless your integrity comes into question.


These question are used to determine whether or not you have demonstrated in the past unethical behavior not becoming to the position for which you were hired.

I believe so.

Are you applying for a job as a PE teacher..................
Sort of sounds like the type of questions they would ask for this........................

They can ask but you also have the right to say "no comment" but then, you might not get the job.
